This document is about the terms and conditions that apply when you buy products from Splashjet Inkjet Ink Private Limited (hereafter referred to as SIIPL). These terms and conditions are important and are meant to protect both you (hereafter referred to as Customer) and the company. They apply to all products sold by SIIPL and its authorized dealers, representatives, affiliates, or online selling platforms.
Product Quality Assurance:
SIIPL makes sure to provide high-quality products to its customers, but certain things could affect the product's performance, like how you use it, the printer and ink system you use, and other factors beyond SIIPL's control.
Limitation of Liability:
SIIPL does not give any other warranties beyond what is stated in this document and is not responsible for any damages that result from improper use of the product or failure to follow SIIPL's instructions. To the extent allowed by the Indian laws, SIIPL disclaims all implied warranties or conditions, including any implied warranties or conditions of merchantability, merchantable quality, and fitness for a particular purpose. SIIPL's maximum liability under this Warranty is limited to the price of the Product(s) or replacement charges, whichever is lower.
Except as indicated above, in no event will SIIPL be liable for:
- Indirect damage caused due to improper functioning of the Product, including but not limited to loss of profits or savings, business interruption, loss of data, lost revenue, loss of use, or any other commercial, personal, or economic loss of any kind, or special, incidental, or consequential damages whatsoever.
- Any claim made by a third party or made by a customer on behalf of a third party.
- Any damage that occurs as a result of the customer's failure to follow the directions given by SIIPL.
- The defect is the result of physical breakage, electric connection, or electrical faults external to the printer and its parts(s).
- Any damage arising out of the printer and its part’s modification, repair, and alteration.
This limitation of liability applies in all circumstances when the damages are sought and a claim is made under this Warranty or any other claim.
This limitation of liability cannot be waived or modified by any person. Even if the Customer has informed SIIPL or a representative of SIIPL about the potential for such damages or even if such a possibility was foreseen, this limitation of liability shall nevertheless apply.
Warranty Period:
The warranty is valid only for 6 months from the date of manufacturing mentioned on the product label. In case the product label does not expressly mention the manufacturing date of the product, the warranty will be valid for 1 month from the date of purchase. The warranty on the ink containers once opened is valid only for 1 month. No claims will be admissible beyond the above-mentioned period.
Warranty Terms:
- Warranty is provided, only on Ink(s), which are purchased from SIIPL, SIIPL Authorized Dealer / Reseller.
- The warranty is limited only to the manufacturing/workmanship defects in the Ink(s).
- All Warrant Services are Carry-In services in the events of which the Customer shall bring their Ink(s) to the nearest SIIPL authorized reseller/ dealer and the customer shall bear the logistics expenses as applicable.
What the Warranty does not cover?
This Warranty does not cover
The malfunction resulting from the use of the Ink(s) in conjunction with any accessories, products, or auxiliary or peripheral equipment, or where it is determined by SIIPL that there is no fault with the Ink(s) itself.
The damages of auxiliaries like cartridges, print heads, papers, chips, or any other products not solely manufactured by SIIPL.
The warranty of functionality of the Ink(s)
Damage caused due to act-of-God & force majeure events including but not limited to damage caused due to fire, water, electrical disturbances, etc.
The damages arising from a replacement, modification, or any alteration done in any part(s) of the products, by a party not authorized by SIIPL.
Further, the drying up/clogging/exhaustion of consumables/cartridges/ink/ink tank are not covered under the warranty.
When is the Warranty nulled or voided?
The Warranty stands nulled or voided if:
- The Label on the product (Ink bottles etc.) is tampered with, damaged, mutilated, illegible, or removed completely or partially.
- The Batch Numbers or any other product details or parts of product details are mutilated, removed completely or partially, or not legible because of any other cause
- The products have been repacked in any way.
- If the physical condition of the product has been altered, qualitatively or quantitatively.
- The product has not been stored as directed by SIIPL.
- The product has undergone any type of physical damage
- The Product is installed, operated, and/or maintained in ways other than the way as has been recommended by SIIPL.
Jurisdiction in case of dispute:
Any disputes arising in connection with this Warranty for the products will be governed by the laws of India through a regular judicial process. The courts of Nagpur shall have exclusive jurisdiction over disputes arising hereinabove.
